When Spurious Charges Backfire

Posted by Joseph D. Lento | Jan 27, 2021 | 0 Comments

Allegations of sexual misconduct, even when untrue, can ruin a defendant's life, career opportunities, and reputation. While some accept the penalties without question, others fight back and receive justice for spurious sexual charges. For one University of Texas professor, accusations of promoting pedophilia prompted an internal investigation, incidents of vandalism, and national news coverage.

While the response was quick, the allegations were false, and the professor is now suing those responsible for libel.

Professor Thomas Hubbard writes about classical depictions of pederasty between men and young boys, such as those in ancient Greece. When Hubbard began teaching a Mythologies of Rape class, outraged students lobbied for his dismissal. However, some of his work is part of peer-reviewed academic journals, and none of it promotes pedophilia.

After the allegations gained national attention, an investigation revealed that Hubbard did not violate any policies. Additionally, Hubbard had no prior sexual misconduct charges or accusations. Yet, due to fear for his safety, Hubbard relocated to another state and now works remotely. He continues to defend his name by taking his accusers to court, but the damage is complete.

Student Sexual Misconduct Allegations

Approaching a sexual misconduct case as a student is tricky, given the sensitive nature of the issue. Erring on the side of caution to protect the alleged victim, innocent defendants like face society's harsh judgment, driving them to extremes to stay safe.

Hubbard's case is just one example of how false sexual charges can ruin lives, but what if the allegations are against a student? Without the right defense strategy and protection from the law, even innocent students can face considerable damage to their educational and career paths.

Taking Action Against Accusations

If you face sexual misconduct allegations, you have a right to defend yourself against these serious charges. Facing a college panel alone, especially without witnesses and evidence, undermines your chance of receiving a fair hearing. An attorney-advisor doesn't let that happen and works to clear your name from baseless allegations.

Some steps to take when you receive word of a spurious sexual misconduct charge include:

  1. Staying calm and avoiding contact with the accuser
  2. Not responding to the allegations without the guidance of an advisor
  3. Refrain from commenting about the issue on campus or through social media
  4. Gather witnesses to corroborate your claims of whereabouts and character
  5. Present evidence to disprove allegations
  6. Understanding your college's policy and what you can do to protect yourself

College administrations (and the law) deal harshly with people who make false statements about sexual assault or misconduct. With an attorney-advisor like Joseph D. Lento overseeing your case, you can challenge damaging claims before they ruin your future.
