“Yes means yes” relates to Title IX campus sexual misconduct cases. Consent is often an issue in Title IX cases where I’ll give the example of a young man being accused of a young woman at college. The allegation would be that the young man did not get consent to engage in sexual activity or intimate activity with her. The argument would be on the young woman’s part that say he took action without obtaining her consent by specific affirmative steps in that regard. Meaning she would have to say literally yes to the requested or sought sexual activity. An experienced attorney advisor can help navigate the process, can help present how the case would need to be articulated to prevent a finding of responsibility. Consent is often an issue and very much is at stake. An experienced attorney advisor needs to be involved in the process from as early as possible.
