Under the Title IX Final Rule, a complainant is defined as the individual who is the alleged victim of the conduct that could constitute sexual harassment. The Title IX Final Rule goes on to state that any third party can file on behalf of who would be the complainant. It could also include a parent or legal guardian, although a parent or legal guardian does not become the complainant, if that's the person who files the complaint, the Title IX Final Rule expressly recognizes the rights of parents and guardians and third parties to file a complaint of sexual harassment on behalf of another.
