High School Title IX Advisor - California

What is Title IX

Better known as simply “Title IX”, Title IX of the Education Amendments of 1972 is a federal civil rights law. It says that an educational institution that receives federal funding cannot discriminate on the basis of sex. Title IX applies to any California schools, and to any schools nationwide, that serve students from elementary school through college. The law prohibits discrimination in high school athletics, admissions, employment, and other areas.

In recent years, Title IX has been controversially expanded to require schools, including high schools, to investigate and take steps to stop alleged discrimination, sexual harassment, stalking, and sexual violence. If a student, teacher, or school staff member has accused your child of sexual harassment, assault, or stalking, Title IX is most likely the law that applies.

Title IX says that a school can be held responsible if the school knows about and ignores sexual harassment or assault in its programs or activities. That's why schools are so eager to take action when a Title IX complaint is made.

Though the law can play an important role in protecting students, schools often schools fail to provide due process to accused students and frequently rush to take the accuser's side. Your student deserves to be heard, too, and your student deserves the same rights he or she would have in a regular California courtroom. Unfortunately, schools can't always be counted on to give both sides the same fairness and consideration.

Title IX Cases in California High Schools

Though most people are more familiar with Title IX sexual harassment and sexual assault allegations taking place in colleges and universities, students in California high schools are also being accused of Title IX violations. Female students at Arcadia High School in Arcadia, near Pasadena, made sexual assault allegations against several male classmates who they say shared videos of themselves having sex with non-consensual girls. At Los Gatos High School in Los Gatos, near San Jose, students recently rallied in support of a student who took her own life several years ago after she said she was sexually assaulted at a party. Female students at Berkeley High School, in Berkeley, wrote graffiti on bathroom walls saying that some of their male classmates were “rapists” and “boys to watch out 4”.

All across California, parents are having to navigate these strange and scary situations in which their children have been accused of horrible acts, often without any form of due process. To make matters worse, California high schools lag far behind colleges and universities in terms of developing protocol and systems to deal with the allegations in a way that is reasonable and fair to everyone involved.

Over the years, the California Legislature has repeatedly sought to encourage California school districts to do more to meet the federal Title IX guidelines, particularly the requirement that each school district must have a Title IX coordinator who can explain Title IX rights to students and instruct administrators on Title IX responsibilities. Despite the years of encouragement from the federal government and California lawmakers, many school districts in the state still do not have a Title IX coordinator. As a result, allegations are often handled badly and students who are wrongly accused are not treated fairly.

Recent Changes to Title IX

The U.S. Department of Education recently issued the first revision to Title IX regulations in 45 years and the revisions go into effect nationwide on August 14, 2020. The revisions have a specific goal of moving how K-12 schools address allegations of sexual harassment and assault to be more in line with the way colleges and universities address those issues. Under the revisions, the investigation process and the due process rights for the accused should become fairer than they have been in the past. However, many school districts are not prepared to implement the revisions. Know Your Student's Rights

When the revision goes into effect, students in California high schools will be entitled to the same process that is currently in place for students in higher educational institutions. However, being entitled to something is not the same thing as receiving it. You and your child must know your child's rights so that you can hold the school accountable for providing these rights. Some of the rights your child is entitled to receive include:

  • A written statement saying that he or she is presumed innocent.
  • A written notice of the allegations
  • A hearing by an unbiased review board or decision-maker
  • A copy of the investigative report
  • To submit questions for any party or witness
  • To receive answers to questions
  • To have a right to appeal the decision
