For college sexual misconduct cases that are not adjudicated under Title IX, schools are free to decide whether or not they will allow cross-examination. Title IX cases are a different consideration. Title IX cases will allow cross-examination, but cases that are going to be adjudicated under the school’s sexual misconduct policy may or may not allow cross-examination. Different schools are implementing different policies as we speak. Some schools are allowing cross-examination whether there’s a hearing or not. At such schools, say, cross-examination could either be in live time or via written format where questions are presented to the other party for a response.
