Grounds for Appealing a Title IX Verdict

Unfortunately, the right to appeal a Title IX verdict is not absolute. There needs to be an acceptable ground for your appeal. These are:

  • The sanction was too severe for the verdict. If the sanction that was issued seems too high for the violation, you can limit your appeal to just the sanction.
  • Your right to due process was violated. For such serious allegations as a Title IX violation, you have a right to be heard in meaningful ways. If this right has been violated or was not taken seriously, you can appeal your conviction.
  • There was a procedural hearing during the process. Schools in Missouri have set procedures for hearing, deciding, and sanctioning a Title IX case. However, these rules are not always followed to the letter, and any variation can prevent you from defending yourself in important ways.
