Student Defense: International American University College of Medicine

The International American University College of Medicine (IAUCOM) holds its students to high standards of conduct and academic progress. Such rigorous standards are vital to ensure that each student is fully prepared for the demands of a medical career upon graduation. They're also crucial for keeping patients safe and maintaining public confidence in the medical profession.

For IAUCOM students, these expectations mean that there's little room for error. Even a single mistake can be enough to trigger significant disciplinary action – including dismissal. While dismissal should only ever be a last resort, IAUCOM will not hesitate to make an example of students who allegedly violate its core policies. As a result, if you're facing dismissal, you need experienced counsel on your side. That's where the Lento Law Firm Education Law Team can assist.

Why You May Be Dismissed From IAUCOM

According to the Student Handbook, you may be dismissed from the International American University College of Medicine for either academic or behavioral misconduct.

Academic Dismissal

IAUCOM will consider dismissal if a student fails to meet its rigorous academic standards. Examples of when a student may be dismissed include failing to:

  • Successfully complete a rotation
  • Complete remedial or probationary coursework
  • Demonstrate an ability to pass basic scientific modules
  • Successfully pass the United States Medical Licensing Examination (USMLE) after two or more attempts
  • Complete or submit mandatory coursework

The school should give students at least two opportunities to complete a rotation, coursework, exams, or remedial modules. This is part of due process as set out in the school's own Handbook. Our firm can assist if IAUCOM proposes to dismiss you without giving you sufficient opportunity to complete these academic requirements.

Behavioral Dismissal

You could be dismissed for behavior that the school deems is in violation of its Standards of Conduct and Honor Code. Such actions include, but are not limited to:

  • Cheating, plagiarism, or academic dishonesty
  • Inappropriate computer use
  • Unprofessional or antisocial behavior (on or off campus)
  • Illegal behavior, e.g., being charged with a felony or misdemeanor

The school has wide discretion for deciding what may constitute an Honor Code or Standards of Conduct violation. The earlier you seek guidance regarding IAUCOM's decision to investigate you for alleged misconduct, the easier it may be to resolve matters informally.

Academic Dismissal Procedures

As noted, IAUCOM students face dismissal if they fail to make what the school deems to be “satisfactory academic progress.” Should IAUCOM have concerns about your ability to fulfill the academic requirements, the steps involved are as follows:

  • You are referred to the IAUCOM Promotions Committee. You may also be placed on academic probation subject to further review.
  • Should you fail coursework while on probation, or if you fail to meet other performance requirements, the Committee will recommend dismissal to the Chief Academic Officer of the College of Medicine.
  • The Officer will either agree to dismiss you or request further information regarding your performance. They will then decide whether to dismiss you or propose alternative disciplinary action.

Alternatives to Dismissal for Academic Progress Concerns

Academic dismissal should only be a last resort. The school should strongly consider alternatives before contemplating dismissal, including:

  • Further remedial coursework
  • More comprehensive support from senior staff and professors
  • Regular progress meetings and reports

Any attempt at remediation, such as retaking exams, can be costly. All disciplinary action must be proportionate and fair – our attorneys will ensure that every avenue is thoroughly explored.

Appealing Academic Dismissal

If you're notified of dismissal, you have only 15 calendar days to appeal to the Officer. They will either reconvene the Promotions Committee or consult the faculty for its opinion. In either case, you have the right to present further evidence to support retaining your place at IAUCOM. The Officer will then make a final decision.

Disciplinary Action for Misconduct

The procedure is similar for misconduct allegations; however, rather than being referred to the Promotions Committee, you will be reviewed by the Grievance/Disciplinary Committee.

  • Complaints against you, received in writing, will be reviewed.
  • Should there be grounds to do so, the Committee will investigate further.
  • The Committee passes its findings (and disciplinary recommendations) to the Chief Officer, who determines the action to be taken.

Alternative Remedies for Misconduct and Related Actions

Although the Student Handbook does not specify alternative sanctions for misconduct, IAUCOM has the discretion to impose lesser penalties rather than dismissal. Our Education Law Team can help you liaise and negotiate with the Grievance/Disciplinary Committee to find the most proportionate solution.

Appealing Misconduct Dismissal

You only have a very short deadline for appealing dismissal based on cheating, behavior, or other misconduct. You must submit a request for an appeal to the Officer within five days of notice of dismissal.

The appeal takes place before a Student Faculty Appeals Committee. This is your chance to present further arguments in your favor. The Committee will review the evidence, including transcripts and witness evidence, and recommend a sanction. The Officer will then decide whether to uphold your appeal or the dismissal – and their decision is final.
