Texas Title IX Appeal Advisor

Under Title IX, Texas schools that receive federal funding are responsible for deterring discrimination on the basis of gender. This law was implemented to ensure that all students have equal access to education regardless of gender, sexual orientation, or gender identity. Title IX prohibits a wide range of actions on college and university campuses, including sexual harassment and sexual assault. If any member of the community files a complaint detailing pervasive misconduct, a school is required to take immediate action.

Students accused of violating Title IX policy at their school will have to undergo a resolution process. It generally involves meetings, an investigation, and a hearing to dictate whether a respondent is “responsible” or not responsible for the alleged misconduct. When a Title IX proceeding results in a finding of “responsible,” the accused has the right to appeal the school's decision.

Your Right to Appeal

Student respondents who believe their case outcome was unfounded or unfair are entitled the right to appeal this decision. An appeal is a request for a school to reconsider its decision. This process exists to keep schools accountable for the decisions that they make. Title IX has serious consequences that can adversely significantly impair the academic and professional careers of students. If a panel or committee did not make the right decision, it should be corrected. This is why it's important to have a full understanding of their right to appeal.

Questions about the appellate process at your school and the course of action that should be taken in your unique situation should be discussed with an attorney. A legal professional can help you draft an appeal that's compelling enough for a school to consider.

Grounds for an Appeal

An appeal will only be considered by a school if its based on the proper grounds. Unfortunately, a decision to appeal a determination and/or sanction will be based on how compellingly you and your appeal advisor can establish at least one of the following specific grounds:

  • Procedural error: a vital mistake was made at some point throughout a Title IX proceeding. It influenced the outcome of a determination and/or sanction.
  • New evidence available: new evidence that could have substantially influenced a case outcome is now available.
  • Disproportionate sanction: the sanction was unduly disproportionate to the severity of the sanction.
  • A violation of due process rights: the school robbed a student respondent of their entitled rights under Title IX and school policy.

Your school's appeal process likely has strict deadlines that you must follow. Check your student handbook to identify the submission deadline so that you can finish your appeal in a timely manner. If your appeal is not timely or substantively eligible, the initial determination and sanction will stand.
