What Is Title IX? 

Title IX is a federal civil rights law that is part of the Education Amendments of 1972 ("Title IX"), 20 U.S.C. §1681 et seq. The law prohibits discrimination based on sex in federally funded K-12 schools, as well as postsecondary education. Title IX applies not only to students enrolled at your school but also to any individual participating in an event sponsored by your school.

One standard within Title IX regulations requires schools to abide by the standard of proof known as ‘preponderance of the evidence'. This results in schools treating Title IX accusations as if they likely happened. In other legal processes, the accused is considered innocent until proven guilty. Under Title IX, all allegations are handled as serious cases, even with reasonable doubt or in the lack of firm evidence.

Title IX in High Schools in Ohio

Sexual misconduct, discrimination, and harassment: These may seem like issues that pertain solely to older individuals. This is not the case. The Washington Post reports that sexual violence occurs in K-12 schools. It can be easy to assume that these are cases where adults are mistreating children. However, according to Ohio's Office of Criminal Justice Services, in 2015, just over 20% of persons suspected of sexual misconduct in Ohio schools were aged 12-17

This does not mean that Ohio high schools have the ability and resources to conduct fair Title IX hearings. New Title IX regulations have been written that require colleges to conduct fair hearings—but not high schools. Your student's school may not be well-equipped to do so at all.
