The short answer to that question is yes. It's important to distinguish between cases that are being adjudicated under your school's Title IX policy versus that are being adjudicated under the school's college sexual misconduct policy. Due to the final Title IX rule that went into effect August 14th, 2020, schools will not be able to pursue alleged acts of sexual misconduct that took place overseas under Title IX.
The schools are free to pursue any alleged acts against a respondent that did take place overseas under their own sexual misconduct policies.
