Michigan High School Title IX Processes and Policies

Each state in the U.S.A. must follow Title IX regulations; it does, after all, apply to every school in the nation which receives federal funding. However, high schools have some flexibility in exactly how they uphold Title IX. This has resulted in state-specific processes and policies which oversee local Title IX cases.

According to the Michigan State Board of Education Code of Student Conduct, the following policies regarding Title IX are in effect: 

  • Any student grade six or above who assaults another student may face suspension or expulsion for up to 180 days if the accuser reports the assault appropriately.
  • After that, the accused student may be able to petition the school board for reinstatement.
  • The accused student must follow any conditions set by the local school board for reinstatement. These may include further education, agreement to a behavior contract going forward, completion of counseling, future progress reviews, or restorative justice processes.
  • If the petition for reinstatement does not succeed, the accused student has no further recourse, and instead must apply to another school.

What Offenses Fall Under Title IX in Michigan?

The federal government initially wrote Title IX over four decades ago to prohibit sex discrimination in benefit decisions—including school admissions as well as participation in athletics and activities. The law has since expanded to cover all instances of sexual discrimination or assault in any school receiving public funding.

In public high schools in Michigan, the following granular definitions of sexual harassment detail the specific actions which fall under Title IX's purview:

  • Level 1 Sexual Harassment includes the use of pictures, words, objects, gestures, or any other action which relates to sex or another person's gender which causes embarrassment or discomfort.
  • Level 2 Sexual Harassment includes unwelcome sexual advances, any conversations eliciting sexual favors, or verbal or physical conduct indicative of an unwanted sexual relationship with another student.

 The division of these actions into two discrete levels assists school officials in disciplinary and reinstatement decisions during the Title IX process.

Michigan School Discipline and Your Student

The Michigan school board realizes that exclusionary discipline and expulsion are not linked to favorable outcomes for accused students. Because of this, Michigan school districts have worked to set a procedure in place to intervene and discipline students in a way protective of their rights. The following activities may occur if your student stands accused of sexual misconduct:

  • Your student's high school will explain the accusations made against your student, and provide the opportunity to speak with a mentor.
  • If your school requires a hearing, your school will provide you, your student, and any legal representatives with all necessary documents, as well as time to prepare your case.
  • If the investigation finds your student innocent, your school may reconsider disciplinary action.

However, it's also written into the Code of Conduct that sexual assault, if proven, is grounds for immediate expulsion.
