Gender-equity civil rights law Title IX forbids gender-based discrimination within any educational activities or programs funded by the government. It is implemented and enacted in the vast majority of schools in Ohio, including the state's colleges and universities. In these settings, Title IX condemns sexual harassment, sexual assault, and other types of gender discrimination that creates a hostile environment for any students. Overall, the enforcement of this law assures that every student, regardless of their gender, sexual orientation, or gender identity receives equal access to education.
When a student is accused of violating Title IX policy at their school, the law requires an institution to take immediate action for resolution. A prompt investigation and hearing will be conducted to either determine the guilt or innocence of a student respondent. If a student is found “responsible” for an alleged violation, he or she has the right to appeal this decision.
Your Right to Appeal
It's important students take advantage of their right to appeal a Title IX outcome. The appellate process in schools exists to hold authorities accountable for their decisions. Title IX sanctions are oftentimes harsh, resulting in program withdrawals, suspension, and expulsion. These ramifications can completely derail a student's academic and professional goals, therefore, it is important that each decision is fair. If a student suspects that a decision is unfounded or inaccurate, they can utilize their right to appeal to determine if this suspicion is reasonable and if a determination and/or sanction should be overturned.
Grounds for an Appeal
An appeal will only be considered if it is based on the appropriate grounds. A decision to appeal a case outcome is dependent on how compellingly you and your appeal advisor can establish at least one of the four following specific grounds:
- Disproportionate sanction: the sanction imposed was unduly disproportionate to the severity of the violation.
- Procedural error: a significant mistake was made at some point during the Title IX process that influenced the outcome of a determination and/or sanction.
- New evidence available: evidence that could have further backed a student respondent and had a substantial impact on the outcome of a determination and/or sanction is now available.
- A violation of due process rights: a student feels as if their school robbed them of their rights entitled under Title IX and school policy.
Appeal submission deadlines come up fast. It's important you abide by all the rules listed in your school's student handbook or code of conduct. If your appeal is not submitted in a timely manner or is not considered substantively eligible, the original finding and sanction will stand.
