High School Title IX Advisor - Illinois

What is Title IX?

Title IX of the Education Amendments of 1972 prohibits discrimination on the basis of sex in education programs and activities and employment. A lot of people are more familiar with Title IX as the law that mandates equal funding and equal opportunities for boys and girls in sports, but the law covers a lot more than athletics. The law, which is enforced by the federal Office of Civil Rights, applies to all forms of sex-based discrimination, and it protects school employees as well as students. In addition, the law applies to all institutions that receive federal financial assistance, either directly or indirectly.

Unfortunately, the phrase “sex-based discrimination” is not defined in the law, leaving it up to some interpretation. Instead, the Office of Civil Rights follows the U.S. Supreme Court's approach in interpreting it as conduct “on the basis of sex”. This means that Title IX covers sexual harassment, which can mean unwelcome sexual advances and requests for sexual favors, and sexual violence, which can include dating violence, domestic violence, sexual assault, or stalking.

Sexual Assault and Sexual Harassment in Illinois High Schools

Illinois high schools are no strangers to accusations of sexual assault and sexual harassment. In February 2020, the father of a Lincoln Park High School student sued the Chicago Board of Education because he said the school did not do enough to prevent his 15-year-old daughter from being sexually assaulted by another student. In November 2019, police were called to investigate allegations that students at a Catholic high school in Champaign sexually assaulted another student. In fact, from September 2019 through February 2020, inspectors with the Chicago Public School system received, on average, more than three reports of sexual misconduct involving students every single day.

What are Illinois Schools Required to Do?

Even if a formal complaint of sexual assault or sexual harassment has not been made, colleges, universities, and K-12 schools in Illinois that receive federal funding must respond:

  • When the school has actual knowledge of the alleged sexual harassment or assault, and
  • If the alleged sexual harassment or assault occurred in an education program or activity of the school. This includes, “locations, events, or circumstances over which the school exercised substantial control.”

Under recently passed rules

  • The definition of sexual harassment has been narrowed. Now sexual harassment is defined as unwelcome conduct that “a reasonable person” would consider “so severe, pervasive, and objectively offensive that it effectively denies a person equal access” to an education program or activity.
  • Parents or guardians of K-12 students may file complaints on the student's behalf.
  • After an assault or a harassment incident is reported, the school must provide written notice to the students involved and their parents about the allegations and any evidence that is gathered. The school must give the accused person at least 10 days to respond.
  • The school must treat the accuser and the accused equitably, by offering supportive measures to an accuser and by following a complaint grievance process before the imposition of any disciplinary sanctions against the accused.
  • The decision-maker must issue a written determination regarding responsibility with findings of fact, conclusions about whether the alleged conduct occurred, and any disciplinary sanctions imposed. The written determination must be sent to both the accuser and the accused at the same time, along with information about how to file an appeal.
  • For each formal complaint of Title IX sexual harassment, the school must keep records for seven years of any actions taken in response to a report or formal complaint of sexual harassment, the basis for the school's response, and documentation that the school took measures designed to restore or preserve equal access, or an explanation for why such a response was not taken.
  • The school's records must also contain any determination of responsibility, any audio or audiovisual recording or transcript, any disciplinary sanctions imposed on the accused, any remedies provided to the accuser, any appeal and the result, and any informal resolution and the result.
