What is Academic Misconduct?

The term academic misconduct covers a myriad of behaviors that violates the educational standards in place in your child's school. Although each school includes different specifics in their definition of academic misconduct, almost all include:

  • Plagiarism: copying or claiming someone else's work as your own.

What is the Process for Students Accused of Academic Misconduct in California?

California has an extensive Education Code that lays out the procedures for every aspect of their public and charter school system. Each high school in the state has its own expression of this code, but they all tend to follow the same procedure.

If your child is accused of academic misconduct in California, you will be notified by your child's school first. At this point, it is important to learn from your child the nature of the incident. Ask them questions about what behaviors they may have exhibited that their teacher or fellow classmates could have interpreted as cheating, plagiarism, or classroom disruption.

The accusation will then be investigated thoroughly by an unbiased individual or committee. After the investigation, if the student is found to have committed an act of academic misconduct, this individual or committee will decide on the subsequent punishment. These punishments may be as simple as detention, or as extreme as expulsion.

Some of the more common techniques used by California high schools to curb academic misconduct are verbal correction, a behavioral contract, counseling from teachers, school counselors, or the administration, and anger management classes. For a student who is found to have cheated or plagiarized, their grade will be reduced. Under the California Education Code Section 48925(d), a student who is recommended for expulsion has a right to a fair and impartial hearing and certain due process rights. Generally, academic misconduct is not grounds for expulsion in any California county.
