A complainant or a respondent can select the advisor of his or her choice in a Title IX case under the Title IX Final Rule. That person can be an attorney. Because of what's at stake in a Title IX case and also what is involved, having an experienced attorney, an attorney who's experienced in Title IX cases is going to be a person's best ally in navigating and understanding the process. An experienced attorney advisor will help a complainant or a respondent work towards trying to ensure a fair process and a favorable outcome. They should be involved as early as possible in the case. A complainant or a respondent's advisor should always be an attorney, just based on what's involved and what's at stake in a Title IX case.
