Under the Title IX Final Rule, a college or university must dismiss allegations or a formal complaint if the allegations did not take place in the school's education program or activity. That is for Title IX purposes only. Under the Title IX Final Rule, a school is allowed to pursue the matter as would otherwise be appropriate to the circumstances as deemed by the school.
Even if the case does not fall under Title IX jurisdiction, a school, or college, or university in many instances will nonetheless still be pursuing the allegations or the alleged misconduct.
