Title IX applies to persons in the United States that are involved in an education program or activity that receive federal financial assistance. Schools are obligated to respond to sexual harassment when that sexual harassment be it in the traditional sense, or sexual misconduct, when that sexual harassment takes place in the education program or activity against the person in the United States.
