Holding Schools Accountable for Head Trauma

Posted by Joseph D. Lento | Apr 02, 2024 | 0 Comments

Over the past decade, as more research on the long-term and debilitating effects of repeated concussions has come to light, stricter guidelines have been put into place to protect high school athletes from head trauma both in practice and during games. The National Federation of State High School Associations (NFHS) and the Sports Medicine Advisory Committee (SMAC) recommend to coaches that if an athlete “exhibits any signs or behaviors that make you suspicious of a concussion, the athlete must be removed from play and not be allowed to return to play until they are evaluated or cleared by a health-care professional.” However, when school staff fail to recognize concussion symptoms in an athlete, the school can and should be held legally accountable. If your child suffered a concussion during a practice or game, contact the Lento Law Firm's personal injury lawyers at 888.535.3686 or through the online form. Your child deserves fighting for.

Suing a School for Your Child's TBI in a Personal Injury Lawsuit

Schools have a duty to ensure the safety and well-being of the students. This includes following the proper concussion protocols when there is any suspicion that a student-athlete suffered head trauma in a game or practice. These injuries require immediate evaluation and, if head trauma is suspected, prompt medical attention. Even seemingly minor head bumps can worsen over the next several hours or days. When coaches and school officials fail to assess these injuries and follow proper protocols, they breach their duty of care to students. According to the NFHS and SMAC recommendations, failing to remove an athlete from activity after a head injury “puts them at risk for sustaining another head injury while concussed, which can lead to worsening concussion symptoms, increased risk for further injury, and, sometimes, even death.” When head injuries go untreated, they can quickly worsen. Parents are left with the immediate medical expenses and long-term costs of medications, rehabilitation, and other services for their child.
