Title IX Attorney to File OCR Complaint in Missouri

According to Title IX rules, schools that receive educational funds from the federal government must ensure that all students have their civil rights protected. The U.S. Department of Education does not tolerate actions such as sexual harassment or assault. Colleges and universities now have assigned coordinators that take disciplinary action when they receive these types of complaints. Often the staff members assigned to investigate these matters fails in affording the accused their rightful due process and protections. Those who are found to have committed an act of misconduct will face sanctions from the school. The Office of Civil Rights (OCR) allows these individuals to file a complaint requesting that the facts and the investigation that was conducted be independently reviewed. Those looking to consider filing an OCR complaint may want to consult with well-established legal counsel such as the Lento Law Firm.

Missouri Title IX Coordinator Discussion (2018)

The Columbia Business Times recently spoke with three Title IX coordinators in Missouri regarding their campus programs.

Stephens College: Shannon Walls is the Title IX coordinator at this women's college with roughly 650 undergraduate students. Walls explained how Title IX investigations are very different than criminal cases. She expounded that “our sanctions are related to the participation within our community” and “range from a verbal warning to expulsion”.

Columbia College: Mark Falkowski is the college's first general counsel. He says that their Title IX program has been progressing nicely. He explained that colleges and universities are increasingly facing “regulation and liability”. He focuses considerable effort on making sure that all parties involved in investigations are afforded “fair due process”.

University of Missouri: Andy Hayes is their assistant vice chancellor of Civil Rights. One of their recent surveys showed that slightly over 20% of respondents had been exposed to “exclusionary, intimidating, offensive and/or hostile conduct”.

Title IX Violations in Missouri

The details regarding Title IX of the Education Amendments of 1972 are found within the Federal Code of Regulations. Title IX regulations apply to all of the various types of educational institutions. Other similar civil rights laws include:

  • Title VI: The Civil Rights Act of 1964 regarding discrimination based on race, color, and origin
  • Section 504: The Rehabilitation Act of 1973 regarding discrimination based on disabilities
  • Title II: The Americans with Disabilities Act of 1990
  • The Age Discrimination Act of 1975

School Investigation & Appeals Process

Educational administrators at colleges and universities have an established process for investigating such complaints. After reviewing the facts they will conduct a hearing where a decision is made. If the accused party is found to have violated the rules they may appeal the ruling. When an appeal is not successful these individuals may consider filing an OCR complaint.

OCR Complaint Considerations

Those who have exhausted their options for avoiding school-imposed sanctions may consider consulting with an attorney regarding an OCR complaint. Experienced legal counsel will protect your best interests and help navigate the process. Keep in mind that you have a limited window of time in which to bring a complaint.
