If you’re a student at a college or university in Colorado and you’re facing a Title IX hearing, it’s important to take the necessary steps in advance of the hearing and at the hearing itself to maximize the prospect of success. An investigation report will be provided at the given time prior to a hearing. It has to be responded to as effectively as possible. All necessary documentation, evidence information has to be included in that investigation report because it gets provided to the hearing panel in advance of the hearing. If a toxicology report is necessary, if a forensic evaluation is necessary, those steps have to be taken well in advance of a hearing. For the hearing itself, for example, opening and closing statements have to be drafted. Questions for all witnesses, be it the accusers and the accused, their witnesses, any expert witnesses if they’re going to be involved in a given matter. The hearing panel itself would have to be considered to see if there’s any potential bias or conflict. Many steps have to be taken to try to maximize the prospect of success at a Title IX hearing.
