Legislative Threats to LGBTQ+ Students

West Virginia isn’t one of the most restrictive states when it comes to LGBTQ+ laws, but that doesn’t mean there are specific protections that apply to LGBTQ+ students anyway. In general, the landscape is characterized by a mix of federal protections and a lack of statewide anti-discrimination laws, though the ACLU of West Virginia has been advocating for a statewide nondiscrimination law that would include protections for LGBTQ+ students.

It must be said, however, that West Virginia doesn’t have laws that bar transgender students from using bathrooms and facilities that align with their gender identities or any laws that prohibit the discussion of sexual orientation and gender identity in school.

However, outside of the federal protections provided by Title IX, there isn’t much in the way of specific legislation to protect LGBTQ+ students. There is currently no state law in West Virginia that prohibits discrimination based on sexual orientation in public schools or universities. Title IX protects against discrimination based on sex on a federal level, which has been interpreted to include sexual orientation and gender identity. But there’s nothing that applies state-wide. Some specific school districts might have anti-discrimination policies, which include protections for LGBTQ+ students, but those protections are limited only to the specific district.
