Academic Misconduct at USD Sanford
USD Sanford’s Medical Student Affairs Handbook includes a Code of Professional Conduct that applies to students in the medical school. The Code lists the various types of academic misconduct that can result in a student facing disciplinary sanctions. The types of prohibited misconduct include:
- Plagiarizing test answers or written work on assignments
- Using “unauthorized notes, tests, or aids” for exams or graded class assignments
- Getting unauthorized copies of test information or test answers before or during an exam
- Leaving an exam while it is in progress, or asking to postpone an exam “under false pretenses”
- Falsifying physical patient exam findings, lab data, or patient history
- Any other action that is “designed to falsely enhance an individual’s performance”
At USD Sanford, the Student Progress and Conduct Committee (SPCC) is ultimately responsible for resolving allegations of academic misconduct made against students. The SPCC has broad authority to issue a range of sanctions from written warnings to dismissing students from the medical school.
These can include the following:
- Making changes to the student’s curriculum or requiring the student to accept certain stipulations before they will be allowed to continue at USD Sanford.
- Placing the student on academic probation, typically with conditions that the student must meet during the probation period.
- Where the student is suffering from “temporary or personal problems,” they may be allowed to take an academic leave of absence.
- Dismissing the student from USD Sanford.

What Happens if I am Accused of Academic Misconduct?
The process for resolving allegations of academic misconduct at USD Sanford varies slightly depending on who is making the allegation. There is one procedure in place when a student accuses another student of academic misconduct. There is a second procedure in place when a faculty member makes the accusation.
When a student believes another student has committed academic misconduct, they can “choose to meet with that student to seek clarification.” If that does not resolve the matter, then the student who raised the issue has an obligation to contact either their class representative on the USD Sanford Code of Professional Conduct Committee (CPCC) or the Associate Dean of Medical Student Affairs. A student who fails to report an academic misconduct violation can themselves be found to have committed a violation of the Code of Professional Conduct.
The CPCC will investigate the allegation. It may decide that there was no infraction; that there was an infraction, but with a satisfactory explanation; or that there was an infraction, but an unsatisfactory explanation.
In cases where there is an unsatisfactory explanation for an infraction, the matter will be referred to the Code of Professional Conduct Board. That board will review the matter and will make recommendations to the SPCC.
Faculty who believe that a student has violated “the spirit or provisions” of the Code of Professional Conduct will file an “Unprofessional Behavior Incident Report” with either the Dean of Medical Student Affairs or with the SPCC.
The SPCC has specific procedures that it follows to consider matters that are referred to it, either by faculty members or by the Code of Professional Conduct Board. The accused student will receive at least 14 days’ advance notice of their meeting with the SPCC, and of course, an explanation of the issues that the SPCC will be considering. The student will be allowed to attend the meeting and present their own witnesses and evidence in their defense.
The SPCC will deliberate in private after the meeting. If the student is to be sanctioned, the SPCC will notify the student after the meeting. If the SPCC is recommending suspension or dismissal, that recommendation will go to the Vice President/Dean of USD Sanford.
