Taking Legal Action When Denied Tenure

Posted by Joseph D. Lento | Oct 12, 2024 | 0 Comments

Pursuing the stability and prestige of a tenured position is a primary goal of many academics. Once a scholar has been granted tenure, they can focus far more on their work, as opposed to the process of earning tenure itself. This process can be time-consuming, draining, and anxiety-inducing. Yet, it is a relatively formulaic process, and those who focus on meeting expectations place themselves in a strong position to secure the tenure upon which their hearts are set.

Of course, tenure is not guaranteed, even if a scholar does everything in their power to achieve this milestone. While there are times when it makes sense to walk away from a denial of tenure gracefully, there are also times when it is prudent and just to push back against this turn of events. For example, if a college or university has violated its internal tenure policies and/or breached a contract with a tenure-track scholar, that individual may be wise to take action.

If you have recently been denied tenure and you're curious about your options, talk to us about your case today by calling 888-535-3686 or by contacting the Education Law Team at the Lento Law Firm online.

A Harvard Scholar Recently Denied Tenure Pushed Back

Although it isn't common for those denied tenure to take their concerns to court, it does happen under certain circumstances. For example, a scholar denied tenure at Harvard recently decided to pursue legal action as a result of the university's alleged violation of its internal policies when evaluating his fitness for tenure. Specifically, he insists that Harvard placed too much weight on negative student evaluations. The scholar simultaneously pursued action against a fellow professor for allegedly sabotaging an employment opportunity that the scholar was seeking in the wake of his tenure denial.

Although the university and the scholar settled the case just before it went to trial, the impact of his circumstances is rippling through Harvard. At least two dozen professors communicated to the university administration that the way the situation had been handled was unreasonably damaging the scholar's academic and scientific reputation. Some of these colleagues even felt that his circumstances were so unjust that they helped to fund his legal bills.
