Schools Race Against the Clock to Implement New Title IX Rules

Posted by Joseph D. Lento | Jun 28, 2024 | 0 Comments

When it comes to schools, it's not just the student body that has to worry about deadlines. School administrators have deadlines, too, although few are as pressing as the upcoming one related to Title IX. The new Title IX rules outline how almost all elementary and secondary schools, as well as colleges and universities, must deal with sex discrimination.

If you've been accused of sexual misconduct or other discriminatory behavior like gender-based verbal abuse, these new rules will likely apply to you. Not understanding the rights provided by Title IX can make the difference in whether there's a positive or negative outcome in your case. This is why any Title IX discipline requires you to contact the Education Law Team at the Lento Law Firm. We have experienced education lawyers that you can reach through our online contact form or by calling 888-535-3686.

The New 2024 Title IX Rules

The Biden Administration released new rules in April 2024, and they were quite extensive. Because they apply to virtually all private and public educational institutions that receive federal funding, they affect the vast majority of educators, school employees, and students in the United States.

These changes aren't incremental and they represent a major overhaul in existing regulations. The most significant changes relate to expanding the definition of sexual misconduct to apply to more behavior, applying Title IX protections to more students, and offering schools more discretion in how they comply with Title IX's requirements. It's this last change that could cause the most problems for schools.

Schools Must Quickly Implement the Title IX Changes

The new rules came out in April of this year, but schools only have until August to understand the changes and decide how to implement them. This gives them just a few months to make the changes and train their employees.

Under normal circumstances for a regular organization, this is plenty of time. But a school trying to overhaul its policies in about 100 days isn't a normal scenario. This is because there are various committees, boards, executives, and stakeholders that will have some say in how these new rules go into effect and how they work. All of these consultations mean the process slows down and can lead to the dreaded “paralysis analysis.”

Then there's the problem of when schools must apply the changes. It's the summer, which means schools are out, and many faculty, staff, and administration are away from campus. The hardest part could be simply getting everyone in the same room or on the same conference call at the same time.

Defending Against Title IX Accusations

The uncertainty that comes with the new Title IX rules is a double-edged sword. On the one hand, it's easier to be accused of sexual misconduct or gender discrimination, given the broader definitions. On the other hand, schools have their hands full figuring out how to discipline students or employees facing allegations of Title IX violations. This is why it's critical to contact the Lento Law Firm's Education Law Team. These nationwide education attorneys have years of experience dealing with Title IX and can take advantage of the confusion many schools face when disciplining someone under Title IX.
