Protecting College Students in Sexual Misconduct Cases

December 20, 2024

A recent poll shows that while incidences of sexual misconduct at Harvard University have dropped sharply since 2019, it is still problematic. Harvard President Alan Garber wrote that despite a “statistically significant decline” in sexual misconduct, its prevalence remains high and threatens the idea that all students can pursue their academic work unhindered.

Colleges polled by the Higher Education Sexual Misconduct and Awareness survey showed an overall decline from 54.6% in 2019 to 45.4% in 2024 for undergraduate women and from 75.8% in 2019 to 67.6% in 2024 for undergraduate men regarding whether students believe a campus official will seriously consider a report of sexual assault. Harvard students also reported being less knowledgeable about available campus resources.

With so much confusion about how schools will handle reports of sexual misconduct, students accused of assault need help navigating their schools’ investigative and disciplinary processes. Contact the LLF National Law Firm Student Defense Team online or by calling 888-535-3686.

Sexual Misconduct Allegations Can Hinder College Education

If you face possible discipline for sexual misconduct allegations at your college, it could threaten your academic future. U.S. colleges and universities experience pressure to investigate sexual misconduct and administer justice. In some instances, an accused student must respond to accusations or participate in a hearing without knowing the details of the allegations against them. Accused students must act immediately to ensure due process and avoid being penalized or expelled.

Title IX is a federal civil rights law passed as part of the Education Amendments of 1972 to protect students from discrimination based on sex. It includes forms of sexual misconduct. Title IX is not part of the criminal code; it is a regulatory procedure for colleges and universities that receive federal funding. The college investigation or hearing process does not give accused students the same legal protections as the criminal justice system.

The U.S. Department of Education recently implemented sweeping rule changes regarding how schools should handle sexual misconduct cases under Title IX guidance. Many schools nationwide also amended their student conduct policies for situations that may not fall under Title IX guidelines. Accused students who need help understanding individual school policies and Title IX should consult the LLF National Law Firm.
