Colleges and Universities Under Title IX Federal Investigation

Students and parents have enough to be concerned about when they or their loved one faces Title IX charges.  It is therefore unfortunate that, in addition to having to be concerned about the potential consequences of an adverse finding, the major disruption to one's academics and personal life even if there is no finding of responsibility, and the like, students and parents have to be concerned that the Title IX investigation and disciplinary process at their school is fairly and properly handled.  The unfortunate reality is that colleges and universities at times mishandle what they are tasked to do, and this can affect both the complainant and the respondent in a Title IX campus disciplinary case.
 
The federal government, through the Department of Education and its Office of Civil Rights in particular (the DOE-OCR), is responsible for investigating colleges and universities nationwide alleged to have either mishandled allegations of sexual assault, sexual violence, or sexual misconduct against students, or failed to investigate such allegations altogether.  The shift in the Department of Education's aggressiveness in pursuing such investigations over the past several years is reflected by the increase in the number of schools under investigation; nearly five times the number only two years ago. 
 
In this era of Title IX enforcement, 312 investigations of colleges and universities have been conducted.  165 of these investigation have been at private schools and 147 have been at public schools.  51 Title IX cases have been resolved and 261 remain open.  The average case duration is 1.4 years.  Five schools have the unwanted distinction of having the most DOE-OCR Title IX cases: Stanford University and St. Mary's College of Maryland with five case each, and Kansas State University, Princeton University, and University of Wisconsin at Madison with four cases each.
