The Kirk Assassination Triggers Reactions
Few things have revealed the fissures in the American psyche more than the assassination of popular but controversial campus debater Charlie Kirk. On the one hand, Kirk’s memorial filled a football stadium with the highest-ranking government leaders and many political and public figures, to celebrate his courage and comfort his widow, the mother of their two young children.
But others, aligned with Kirk’s alleged murderer’s transgender and Antifa views, which the alleged assassin inscribed on the bullets he prepared for Kirk, mocked Kirk on social media and in other comments. Criticizing Kirk’s legacy as hateful and the man himself as so evil as to deserve his fate, some mimicked his assassination and even encouraged further violence to silence those sharing his views.
Discipline over Speech is a Significant Risk
While schools hold strong commitments to free speech, so essential to their academic environments, college and university campuses are nonetheless one of the most regulated environments in which you’ll find yourself. Students exercising their free speech rights can readily face disciplinary charges under student codes of conduct discouraging threatening and offensive speech. Professors, instructors, and employees can likewise face employment discipline for not respecting the varying cultures and commitments within diverse student bodies. Don’t be surprised at your disciplinary issues. Cancel culture has long been alive and well on university campuses, even if in the Kirk instance, the shoe is on the other foot.
Free Speech to the Rescue
But students and instructors do not give up their free speech rights on campus. To the contrary, the traditional commitment of schools has been to a healthy and open environment of debate, in a marketplace of ideas. Indeed, Kirk himself was the greatest recent example and proponent of healthy debate, taking on all comers no matter how different their views were from his own. If you have already suffered dismissal, suspension, or other discipline, or if you face disciplinary threats and charges, you have rights to a fair hearing to protect your property and liberty interests in your employment and education.
