Jury Hands Down Almost $4 Million Award, Siding With Suspended Student

Posted by Joseph D. Lento | Sep 27, 2023 | 0 Comments

According to Oregon Public Broadcasting, recently, a jury verdict handed down an award of nearly $4 million in damages for Peter Steele, a former student at Pacific University. Although the jury did not agree with all of Steele's claims, it did side with him on two of them. Accused students have rights, and the Lento Law Firm fights to protect them. What Happened at Pacific University

In 2020, the university indefinitely suspended Steele following accusations of sexual misconduct and physical assault made by another student. Steele asserts the relationship was consensual. In this case, “The two claims the jury sided with Steele on were that Pacific had breached the “implied covenant of good faith and fair dealing” — essentially that Pacific did not act in a generally fair and reasonable way — and that the university had intentionally inflicted emotional distress on Steele.”

While this is a victory for Steele, he cannot get those years back. Title IX and sexual misconduct cases can be very serious and have a long-term impact on the lives of the accused.

Pacific University didn't provide Oregon Public Broadcasting with an interview. Their Assistant Director of Communications, Blake Timm, issued a statement which says they're considering whether to appeal the decision.

What Does This Mean for Title IX Defense?

Title IX is a federal law designed to prevent sex-based discrimination in education. The jury found in Pacific University's favor for some of the claims. For example, they didn't violate Title IX. The finding for Steele, however, demonstrates just how much students need an experienced professional on their side. For example, an attorney from the Lento Law Firm can help them navigate this sort of complex situation. A professional will understand how to work for the best possible outcome for the student accused of misconduct.
