How to Get the Proper Help for Your Child Under the Disabilities Education Act (IDEA)

Posted by Joseph D. Lento | Sep 12, 2024 | 0 Comments

The federal government is considering ways to improve the way it measures and reports back to states their progress in educating special needs students. This comes after criticism that the latest reports are misleading and not as helpful for states as they could be. Critics claim that the way the process is structured pits states against each other instead of incentivizing all states to succeed.

If you're worried your child is not being given the attention they deserve and is falling behind because of it, the Lento Law Firm Student Defense Team can help you make sure your child is getting the services they are entitled to. The Suggested Updates to the Individuals with Disabilities Education Act (IDEA)

The federal government uses various metrics to assess the state's progress in implementing the Individuals with Disabilities Education Act (IDEA). These metrics include categories like "needs assistance," which indicate areas where states require improvement. While some states demonstrate better performance than others, there's a growing concern about the accuracy and effectiveness of these federal measurements.

For 2025 and beyond, the Education Department is considering three specific updates to improve results for children with disabilities. These could include:

  • Prohibiting a state from attaining “meets requirements” if the Office of Special Education Programs identifies long-standing noncompliance for at least three or more years.
  • Whether and in what way to continue including NAEP (National Assessment of Educational Progress) participation and proficiency in the state determinations.
  • What additional factors should be added to measure improvement in proficiency rates on statewide assessments?

What This Means for Students

If a state is categorized as "needing assistance," it could mean that students with disabilities in that state may not be receiving the appropriate education and support services they are entitled to under the IDEA. This can have significant consequences for a child's academic and social development.

However, even within a state that “meets requirements,” the state cannot ensure that every single child who needs assistance is getting it. The best way to get your child the proper help is to familiarize yourself with IDEA and with the services your child is entitled to. The Lento Law Firm Student Defense Team can help break down the complicated parts of the process and ensure your child is getting the assistance they need.
