Dismantling the Department of Education: What’s at Stake?

Posted by Joseph D. Lento | Apr 12, 2025 | 0 Comments

A new executive order rewrites the rulebook, aiming to dismantle the Department of Education. Titled “Improving Education Outcomes by Empowering Parents, States, and Communities,” it's a game changer. But is this a step toward progress or a move that will leave students and parents in the lurch?

Not sure how these changes impact your child? Reach out to the experienced attorneys at the Lento Law Firm Student Defense Team. We're here to answer your questions. Call us at 888.535.3686 or fill out our confidential consultation form.

What's in the Executive Order?

In a nutshell, the order reduces federal influence over education. As the Department of Education recedes, states and school boards are in the driver's seat. The order slashes federal funding, yanking the rug out from under programs on diversity, equity, and inclusion and those pushing gender ideology. The reason? To put an end to what the administration believes is discrimination.

What Could This Mean for Students?

The executive order's a radical shift, no doubt. But what does it mean for students?

  • A More Tailored Education Experience: States and school districts can now align policies with local needs so the curriculum speaks to the challenges and cultures students experience every day.
  • Parents in the Driver's Seat: With more power at the local level, parents have a bigger say in what happens at their child's school.
  • A Lab for Fresh Ideas: Without the iron grip of federal mandates, schools can try new techniques and customize learning environments. After all, who likes bureaucracy, especially unaccountable bureaucracy?

But there's a flip side…

The Potential Pitfalls: What's at Stake

Critics are raising alarms about the potential fallout:

  • The Gap Grows Wider: In resource-poor areas, students may face a much lower quality of education compared to their peers in wealthier districts.
  • Funding Gaps: Federal funds have been a lifeline for underfunded schools in low-income areas. If states are left to fend for themselves, the disparity between well-funded and underfunded schools could grow.
  • Fewer Protections for Students: One of the roles of the Department of Education has been to enforce civil rights laws in schools. With that oversight gone, who will hold schools accountable for discrimination?

While getting rid of bureaucracy is a great goal, does this order throw the baby out with the bathwater?
