The CUNY-Brooklyn College Rules and Regulations

As part of the City University of New York (CUNY) system, Brooklyn College subscribes to the Henderson Rules, a set of guidelines for conducting yourself as a CUNY student. These rules are written broadly to cover virtually any kind of misbehavior a college student might commit. We don’t have time to go over all the ins and outs of the Henderson Rules, but we do want to mention some of the most serious regulations, the ones that tend to bring the most serious consequences. These are the offenses you want to avoid committing at all costs.

  • Physical Violence: All communities have a responsibility to protect its members. Thus, the most serious infraction you can commit at CUNY-Brooklyn, or in any other community, is physical violence.

  • Weapons Possession: To further protect students and faculty, the college also prohibits weapons possession. This applies to all firearms and “any other dangerous instruments or material that can be used to inflict bodily harm on an individual.”

  • Hazing: CUNY-Brooklyn’s prohibition on hazing prohibits any physical, psychological, or emotional harm you might cause to others in the course of organizational initiation.

  • Sexual Misconduct: These offenses are actually governed by federal law, under Title IX. CUNY-Brooklyn is required to investigate all credible accusations and encouraged to impose harsh penalties.

  • Illegal Drugs: The college’s ban on illegal drugs extends to manufacture, distribution, dispensation, possession, and use.

Obviously, if you’re dismissed, you’ll have to give up your spot at CUNY-Brooklyn College. That means walking away from the community you’ve created and the academic progress you’ve made.   • The chief student affairs officer then conducts an investigation into the circumstances of the case. As part of that investigation, you’re entitled to give your side of the story. In addition, this student affairs officer must keep you apprised of any evidence they uncover in your case.

  • The university can dismiss the charges against you if it can’t find any evidence to substantiate the charges. However, it could also refer your case to a formal hearing.

  • At any hearing, both sides have the chance to present their cases. This means you can introduce evidence and call witnesses to testify. You can also raise questions about any evidence being used against you.

  • The standard of evidence in the CUNY system is “preponderance of the evidence.” In simple terms, you’re “responsible for” (guilty of) an offense if it seems “more likely than not” that you committed it.

  • You can appeal a responsible outcome, but you must have grounds on which to file such an appeal. These usually have to do with issues of fairness: were you given a fair chance to defend yourself? Did you have access to all the evidence in the case? Were you judged by trained, unbiased decision-makers?
