College Discipline for Neurodivergent Students: When ‘Behavioral Expectations’ Ignore Disability Law

August 11, 2025

Many neurodivergent students learn early that they may face punishment for behaviors that are outside their control. This unfortunate reality persists in college, where students face allegations of behavioral misconduct related to sensory overload. While K-12 schools are likely to ask how disability status affects behavior, colleges frequently neglect this important consideration. Many colleges mistakenly believe they are not required to accommodate disabled students, while others simply fail to understand how neurodivergence can manifest behaviorally. It is essential that colleges take responsibility for recognizing and addressing these issues to create a fair and supportive environment for all students.

Legal Protections for Neurodivergent College Students

At the college or university level, students are protected against discrimination based on disability by Section 504 of the FRA and the Americans with Disabilities Act (ADA). To be covered under these laws, a student must be a qualified person with a disability, and neurodivergence, including ASD (Autism Spectrum Disorder), qualifies as a disability. Beyond discrimination based on disability, colleges are also required to provide reasonable accommodations to neurodivergent students under these laws.

While colleges have the right to discipline students, they may not enforce behavioral expectations without reference to disability. For many students, these protections are critical.

College Discipline for Neurodivergent Students

Neurodivergent college students may face charges for code of conduct violations or behavioral issues. The problem for many students is that colleges often fail to take into account how neurodivergence affects behavior. Many neurodivergent young adults are more sensitive to their environments than neurotypical peers, and this will sometimes lead to sensory overload, meltdowns, or other behavioral issues.

If a neurodivergent student faces college discipline for behavioral issues, it is vital that they present evidence of their disability. This may be done through negotiations between their attorney and the college. If there is a due process hearing, the decision-maker must hear evidence of how neurodivergent status may have affected the student. It may not be your job to educate the world on neurodivergence, but it is often vital to a defense against misconduct charges.
