The DU Decision

As the debate about LGBTQ+ protections for students wages on, California has passed some of the most progressive laws in the country. Designed to protect students, the laws include mandatory LGBTQ+ training for teachers, access to all-gender restrooms, and prohibitions against diversity-related book bans.

For public school teacher Jessica Tapia, the restrictions caused an ethical dilemma. Tapia is a Christian who found the new laws at odds with her religious beliefs. According to Tapia, the district's requirements caused her severe mental anguish and made it tough to focus on doing her job.

The school district settled Tapia's wrongful termination lawsuit for $360,000, stating that paying the settlement was not admitting wrongdoing. Officials simply felt the settlement was in the best interest of the students.

On the flip side, in some conservative states, education workers have filed First Amendment lawsuits. Those lawsuits claim that the laws make it tough for teachers to create inclusive environments for their LGBTQ+ students.
