AI-Related Misconduct Allegations Require Quick Response

Posted by Joseph D. Lento | Jun 09, 2026 | 0 Comments

Because college and university faculty members exercise discretion when addressing their students' misuse of artificial Intelligence (AI), the same and similar violations can result in radically different disciplinary outcomes.

A recent examination of Maryland colleges and universities determined that schools across the state struggle to define the role of AI in higher education. Faculty members often exercise considerable latitude in defining the proper use of AI in their courses and addressing any violations. As a result, the same infraction can result in wildly disparate outcomes for the same infraction:

  • Informal Resolution: An informal resolution allows the teacher and the accused student to address the allegation outside of the college or university's formal student disciplinary process. In these cases, a teacher often issues a warning to or lowers the grade in response to a student's infraction. Importantly, the allegation is not entered into the student's permanent record.
  • Formal Disciplinary Complaint: When a teacher pursues a formal disciplinary complaint against a student accused of improperly using AI, a disciplinary investigation and subsequent hearing may occur. Any sanction will likely be entered into the student's academic record.

At the LLF National Law Firm, we know that there is a significant difference between a lower grade and a formal disciplinary sanction for misusing AI in college and universities. Our Education Law Team defends students accused of violating student conduct and academic codes by advocating for informal resolutions and preparing to provide a comprehensive defense, if necessary.  To discuss your case, call the LLF National Law Firm offices at 888-535-3686 or complete our online consultation form.

What Should a Student Do if They Are Accused of AI-Related Misconduct?

When students are asked to navigate vague AI policies and inconsistent disciplinary outcomes, they are often unable to understand the ramifications of a misconduct violation.

As a result, any student accused of improperly using AI in coursework or scholarship should proactively defend themselves against the allegation by:

  • Contacting the LLF National Law Firm as soon as possible. The best defense strategies begin immediately after a professor or other faculty member suggests that AI has been inappropriately used. By quickly responding to any hint of misconduct, we hope to resolve the matter informally and lay the groundwork for a more comprehensive defense if the school begins a formal disciplinary investigation.
  • Collecting any documents related to the accusation, including the assignment, research notes, draft documents, emails, and university, department, or faculty-specific policies about the integration of AI in coursework.
  • Preparing notes about any conversations with faculty about the assignment and the proper use of AI. By maintaining an accurate and complete account of what accusations have been made and how the student has responded, our Education Law Team can develop a strategy to challenge any misconduct allegation, either through informal action or by preparing for a formal investigation or hearing.

At the LLF National Law Firm, we know that our early intervention in student misconduct cases, including those involving AI, may increase the likelihood of an informal resolution. Let our experienced attorneys help you navigate AI-related disciplinary accusations, investigations, or hearings at your college or university.

Let the LLF National Law Firm Protect You

AI is redefining higher education at an unprecedented rate and in unexpected ways. When colleges and universities fail to provide clear and consistent guidance on the proper integration of AI, students are left to navigate this complex technology on their own.

When students falter and make mistakes in this new frontier, we must protect their education and future.

If your college or university accuses you of improperly using AI, let us help. To partner with our Education Law Team, contact the LLF National Law Firm offices by phone at 888-535-3686 or online.
