Accused of Antisemitism in School? There's Only One Thing to Do.

Posted by Joseph D. Lento | Feb 16, 2024 | 0 Comments

Conflict in the Gaza Strip has brought Israel and Palestine into the public discourse like no time in recent memory. This conflict has made its way to the United States, pitting those with differing opinions about the conflict against each other. Those who express sympathy or support for Palestine or criticism of Israeli policy or tactics may face charges of antisemitism.

If you or your student faces any allegation that threatens their reputation or has the potential for formal sanctions, allow the Lento Law Firm's Education Law Team to advocate on their behalf. Call the Lento Law Firm today at 888.535.3686 or contact us online.

Jewish Students Report a Rise in Antisemitism on Campus

It is understandable why a student may be falsely accused of antisemitism, as there has undoubtedly been a rise in antisemitic behaviors on campuses. A reported 73% of Jewish college students have witnessed or experienced antisemitism since the start of the 2023 school year.

Students at Santa Monica College even reported institutional discrimination following the outbreak of armed conflict in the Gaza Strip. Harvard University faces a lawsuit from students alleging rampant antisemitism in Cambridge.

It is important to note, though, that the existence of antisemitism on campus does not mean you or your student are guilty of the offense.

Some Students Have Faced Unfounded Allegations of Bigotry

During such chaotic times, students must be treated as individuals. Students with complex views are often painted as intolerant merely for holding a specific opinion (or even because they are misunderstood).

A student may be accused of antisemitism if:

  • They voice support for Palestine
  • They are critical of Israel's policies or tactics
  • They are mistaken for another student who has engaged in antisemitism (or perceived antisemitism)
  • They take any action or say any statement that someone perceives as antisemitic

Like any hate crime, there is some subjectivity in what does and does not qualify as antisemitism. Spoken words, social media posts, classroom debates, and countless other forums can be conduits for misunderstandings and perceived antisemitism. Perceived antisemitism, though, does not always qualify as antisemitism.

The consequences of an antisemitism allegation can be formal and severe. Students can even be charged with hate crimes or face other similarly serious consequences based on a mere accusation of antisemitism or bigotry.

Our firm has seen highly accomplished students face dismissal for cultural differences, baseless allegations of hate, and other circumstances that did not warrant such severe sanctions.
